1. Acceptance of Terms

By accessing or using FXAnalytics by AI ("the Service"), located at fx-analytics.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.

2. Description of Service

FXAnalytics by AI is an experimental, AI-powered forex market analysis platform. The Service aggregates signals from multiple AI agents to produce directional consensus, regime detection, support/resistance levels, sentiment analysis, and related market commentary for informational and educational purposes.

3. Not Financial Advice

The Service does not constitute financial advice, investment advice, trading advice, or any other kind of professional advice. All content, signals, predictions, analysis, and data provided by the Service are for informational and educational purposes only.

You should not make any financial, investment, or trading decision based solely on information provided by the Service. Always conduct your own research and consult with a licensed financial advisor before making any trading or investment decisions.

4. No Guarantee of Accuracy

AI-generated signals and analysis are inherently probabilistic and may be incorrect. The Service makes no warranty or representation regarding the accuracy, completeness, timeliness, or reliability of any information provided.

• Past performance of the system, including published accuracy metrics, does not guarantee or indicate future results.
• Accuracy percentages reflect historical directional consensus versus subsequent market movement and are subject to change.
• Market conditions can change rapidly and without warning, rendering any analysis immediately outdated.
• AI models may produce incorrect, contradictory, or misleading signals at any time.

5. Assumption of Risk

Forex trading involves substantial risk of loss and is not suitable for all investors. You could lose some or all of your invested capital. By using the Service, you acknowledge and accept the following:

• You are solely responsible for your own trading and investment decisions.
• You understand the risks of leveraged forex trading, including the possibility of losing more than your initial deposit.
• You will not hold FXAnalytics by AI, its operators, or its affiliates liable for any financial losses incurred as a result of using or relying on the Service.
• You acknowledge that AI-generated analysis may contain errors and should never be the sole basis for a trading decision.

6. Limitation of Liability

To the maximum extent permitted by applicable law, FXAnalytics by AI and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or savings
• Loss of data or trading opportunities
• Damages arising from trading decisions made using the Service
• Damages arising from service interruptions or outages
• Damages arising from inaccurate, delayed, or incomplete data

This limitation applies regardless of the theory of liability, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.

7. Service Availability and Reliability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, continuous, or error-free operation of the Service. You acknowledge that:

• The Service may experience downtime, outages, or interruptions at any time, whether scheduled or unscheduled, with or without prior notice.
• AI agent processing, data feeds, market data providers, and third-party services may become temporarily or permanently unavailable.
• Signals and analysis may be delayed, stale, or unavailable during periods of high market volatility, system maintenance, or infrastructure issues.
• We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time without prior notice or liability.
• No service level agreement (SLA) or uptime guarantee is provided. We make commercially reasonable efforts to maintain availability but accept no liability for outages.

8. Data Sources and Third-Party Services

The Service relies on third-party data providers, APIs, and market feeds. We are not responsible for the accuracy, availability, or reliability of third-party data. Data feeds may be delayed, incomplete, or contain errors introduced upstream.

9. Intellectual Property

All content, analysis, AI-generated signals, software, design, and other materials provided through the Service are the intellectual property of FXAnalytics by AI. You may not reproduce, redistribute, sell, or create derivative works from any content provided by the Service without express written permission.

10. User Conduct

You agree not to:

• Attempt to circumvent, disable, or interfere with any security or access-control features of the Service
• Scrape, crawl, or automated-harvest data from the Service without authorization
• Reverse-engineer, decompile, or attempt to derive the source code or underlying algorithms of the AI agents
• Redistribute, resell, or sublicense any paid content or signals without authorization
• Use the Service in any way that violates applicable laws or regulations

11. Subscription and Payments

Paid tiers, when available, are billed on a recurring basis. Subscription terms, pricing, and refund policies will be detailed at the point of purchase. We reserve the right to change pricing with reasonable notice. Free-tier access may be modified or discontinued at any time.

12. Communications and Notifications

By using the Service, you consent to receive notifications, alerts, and communications from FXAnalytics by AI, including but not limited to: trading signal alerts, system status updates, account-related messages, service announcements, and promotional content.

• Notifications may be delivered via email, in-app messages, browser push notifications, or other electronic channels as the Service evolves.
• You may opt out of non-essential communications (such as promotional content) through your account settings. However, operational notifications — including system status changes, account modifications, security alerts, and updates to these Terms — cannot be disabled while your account remains active.
• We are not liable for missed, delayed, or undelivered notifications due to technical issues, spam filters, network conditions, device settings, or any other cause beyond our reasonable control.
• Notification delivery is provided on a best-effort basis with no guaranteed delivery times or delivery confirmation.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without prior notice or liability. Upon termination, your right to use the Service ceases immediately.

14. Indemnification

You agree to indemnify, defend, and hold harmless FXAnalytics by AI, its operators, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your trading or investment decisions.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

16. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
